Chart for Grievance Procedure Time Limits

Every grievance procedure has specific time limits for filing a grievance, for management to hear the grievance, for management to respond in writing, and for the union to appeal an unsatisfactory response to the next step. Below is a chart of the time limits for the procedure under article 8.5 Grievance Procedure.

Grievance Time Limits

Grievances are appealed to Arbitration by a vote of the Local Union Executive Board at a monthly Executive Board meeting.  If it is voted to pursue to Arbitration a letter is sent to Penn State Office of Human Resources and the Local Union Attorney, in conjunction with the Union, picks an arbitrator.  Penn State OHR notifies the arbitrator and sets up the arbitration date and location. If the University and Union do not come to a settlement prior to the arbitration date the grievance is arbitrated. The Arbitrator has 30 days to render a decision and can ask for an additional 20 day extension if needed.
